Legal Clinic (34) : Defect of China's Criminal Lawsuit System from the Perspective of Criminal Defense

    At 19:00 on May 7, 2024, the 34th session of Legal Clinic Series Activities was successfully held in Lecture Hall 320 of the Law School. Ye Lei, a lawyer from Anhui Huaihe Law Firm, was invited to give a lecture entitled Defect in China's Criminal Procedure System from the Perspective of Criminal Defense for teachers and students of our college. This activity was hosted by Lei Geng, a teacher from our college. Students majoring in law in grade 22 attended the lecture.


    Lawyer Ye Lei started this lecture from four perspectives: the origin and development of the criminal defense system, the emergence and development of China's criminal defense system, the classification and significance of criminal defense and the analysis of practical cases. Criminal defense is the brightest pearl in the crown of law and the most complex skill in the legal profession. Lawyer Ye Lei, who has worked in the field of criminal defense for many years, stressed: Criminal defense is conducive to the disclosure of objective truth and restrain the one-sided and arbitrary nature of judges.


    In the warm communication with the students, lawyer Ye Lei expressed to us what he considered to be the five regrets in criminal defense: the lack of relief protection of the right to intervene in advance, the narrow scope of the identity of the defense client, the lack of lawyers' right to be present in interrogation, the lack of mandatory provisions on the synchronization of audio and video recordings during interrogation of general criminal cases, and the limited rights of lawyers to investigate and collect evidence. I hope students can become excellent legal practitioners in the future, and the above regrets will no longer be regrets. With the explanation of lawyer Ye Lei, Teacher Lei Geng encouraged the students to combine theoretical knowledge with practical experience in the future. In the process of future study and life, from practice to practice, apply legal theory to judicial practice.
